Terms of Service

Overview

These Terms of Service govern your engagement with aibility.systems, an AI systems brand of Sasha Business Growth ("aibility," "we," "us," "our").

By engaging our services — whether through a signed proposal, a payment, or a written agreement — you confirm that you have read and agree to these Terms. If you are entering into this agreement on behalf of a company or business, you confirm that you have the authority to bind that entity.

Services

aibility builds AI-powered operational systems for manufacturing and B2B businesses. Our systems are designed to reduce hiring requirements, reduce founder time in operations, and make businesses run on systems rather than on people.

The specific scope, deliverables, systems to be built, and timeline of each engagement are agreed in writing before work begins. What is agreed in that document — and only that — constitutes the scope of our obligation to you.

We do not guarantee specific business outcomes, revenue results, or operational improvements. We guarantee delivery of the agreed technical scope.

Intellectual Property

The systems we build may incorporate proprietary frameworks, logic, code structures, templates, and methodologies developed by aibility over time.

Upon receipt of full payment for an engagement:

  • You own your data and all data processed through the systems we build for you.
  • You own the right to use, operate, and benefit from the systems as delivered.
  • aibility retains ownership of the underlying code, frameworks, architecture, and methodology used to build those systems.
  • You may not resell, license, sublicense, or commercially exploit the systems we build to third parties without our prior written consent.

Client Obligations

For us to deliver, you agree to:

  • Provide timely access to the tools, platforms, accounts, and data required for the build — including but not limited to your WhatsApp Business account, Wati workspace, Tally data, and Google Sheets as applicable.
  • Ensure that credentials and data you share are lawfully yours to share.
  • Make decisions, provide approvals, and give feedback promptly when requested.
  • Assign a point of contact on your team who is available and empowered to make decisions throughout the engagement.

Failure to meet these obligations may result in project delays or pauses, for which aibility is not responsible.

Payment

Payment terms are agreed per engagement in a separate proposal or agreement document. All fees are in Indian Rupees (INR) unless otherwise stated.

All fees are exclusive of Goods and Services Tax (GST). GST at 18% is applicable on all services and is payable additionally by the client.

Delayed payments may result in the project being paused until outstanding amounts are settled.

No Refunds

Once work begins on your engagement, all fees paid are non-refundable — regardless of whether you choose to pause, discontinue, reduce scope, or end the engagement for any reason.

We invest significant time, resources, and expertise from the moment an engagement begins. This policy reflects that reality and applies without exception.

If there is a genuine dispute about whether agreed deliverables were met, that is handled separately under the Governing Law clause.

Post-Delivery

Our obligation ends at delivery of the agreed scope. We do not provide ongoing support, maintenance, bug fixes, or updates after delivery unless this has been explicitly agreed in writing as a separate arrangement.

It is your responsibility to maintain the tools, accounts, and third-party platforms the systems depend on — including your WhatsApp Business account, Wati subscription, and any connected services.

Project Delays

If delays arise on your side — including but not limited to delays in providing access, credentials, approvals, feedback, or decisions — the project timeline extends accordingly. aibility is not liable for delays caused by the client.

We reserve the right to pause an engagement where client delays make active progress impossible, and to restart it at a date of our choosing once the required inputs are provided.

The agreed fee remains payable in full regardless of such delays.

Confidentiality

We treat all client information — including business data, customer data, operational details, financials, and communications — as strictly confidential.

We do not share, sell, publish, or disclose client information to any third party without your explicit consent, except where we are required to do so by law or by a competent authority.

This obligation continues after the engagement ends.

Limitation of Liability

Our total liability to you in connection with any engagement shall not exceed the total fees paid by you to us under that specific engagement.

To the maximum extent permitted by applicable law, aibility is not liable for:

  • Indirect, consequential, or incidental losses
  • Loss of profit, revenue, business, or data
  • Losses arising from your use or inability to use the systems we deliver
  • Losses arising from changes to third-party platforms the systems depend on

Governing Law

These Terms and any disputes arising from or related to your engagement with aibility are governed exclusively by the laws of India.

Any dispute shall be subject to the exclusive jurisdiction of the courts of New Delhi, India. By engaging our services, you consent to this jurisdiction.

Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top. The version in effect at the time of your engagement applies to that engagement.

Continued use of our services after an update to these Terms constitutes acceptance of the revised Terms.
